are mentioned and comprised in the 28th Article of an Order in Council issued on the 3rd of March, 1839: The Jurisdiction given is both Concurrent and appellate - but by another Order in Council dated 23rd January, 1860, (Seven days before the date of the Letters Patent) the order of March, 1839, was revoked and Cancelled
The Consuls are therefore acting under the Authority of one order in Council, whilst my jurisdiction to hear appeals from the Consular decisions is, by the Letters Patent, limited to another order which has already been repealed.
There is at this moment in Hongkong a gentleman who is desirous of commencing an Action against a British functionary in Japan in respect of a matter arising out of the provisions of the Order in Council of January 1860 - but I am not in a position to try the Case, nor shall I be until the Letters Patent are amended.
I beg also to observe that no notification whatever has been made in Hong Kong of the issue of the Order in Council of January 1860 revoking that of March, 1839 - the only announcement of it being contained in a newspaper published at Shanghai and which is declared to be the official Organ of Her Britannic Majesty's
